1. About These Terms
These Terms & Conditions apply to your use of Simulation Tone Shop and to purchases made through this website. Simulation Tone Shop is operated by the operator identified below.
2. Products
Simulation Tone Shop sells downloadable digital products for guitar processors, primarily HeadRush tones, rigs, scenes, IRs and related pack files. The product page determines the contents, features and stated compatibility of each pack. Compatibility is not universal and should be checked before purchase.
3. Orders and Payment
Prices and the order total are shown during Checkout. Production payment methods are PayPal and card payments via Stripe. Payment availability may depend on the customer’s location and the configuration presented at Checkout.
4. Digital Delivery
Our products are digital and are made available electronically after successful payment and order processing, according to the store workflow. Access is provided through the order/download process and, where available, the customer account.
5. Right of Withdrawal and Digital Content
By placing an order for digital content, you may be asked at Checkout to expressly request immediate access before the end of the applicable withdrawal period and to acknowledge that, once delivery begins under the applicable conditions, the right of withdrawal is lost as provided by applicable law. Mandatory consumer rights remain unaffected.
6. Refunds and Technical Problems
Downloaded digital files are normally non-refundable once digital delivery has begun under the applicable conditions. This does not exclude mandatory statutory rights. If a file is corrupted, inaccessible, incorrect or affected by another technical delivery problem, please contact us through the Contact page so that the issue can be reviewed.
7. License and Permitted Use
Purchase grants you a limited right to use the purchased files. You may use them personally or professionally as part of your own musical performance and production, including live performance, studio or recording use, and modification for your own use.
You may not redistribute, share, resell, sublicense or upload the purchased files, or make the original or modified downloadable files available to third parties. Ownership and copyright of the underlying Simulation Tone Shop files are not transferred by purchase. These restrictions do not prohibit your commercial musical activity merely because you used Simulation Tone Shop files to create or play music.
8. Product Compatibility
Compatibility information is provided on individual product pages. You are responsible for checking that a pack is suitable for your equipment before purchase.
9. Accounts
Where account functionality is available, you are responsible for keeping your login credentials secure and for the activity carried out through your account. Account features may include access to order history, downloads and account details.
10. Product Reviews
Customers may be able to submit reviews for products. Reviews should be relevant, accurate and lawful. Simulation Tone Shop may moderate or remove reviews that are unlawful, misleading, abusive, irrelevant or otherwise unsuitable for display. This section does not grant Simulation Tone Shop rights over your name, voice or likeness beyond what is necessary to display and administer a submitted review.
11. Intellectual Property
Simulation Tone Shop retains the rights in its website content, branding and downloadable products except where stated otherwise. Third-party names, product names and trademarks belong to their respective owners. Artist names and references do not imply affiliation with or endorsement by those artists or by HeadRush.
12. Third-Party Services
The website may rely on third-party services for payment, embedded content, security and analytics. Their processing and use are addressed where applicable in our Privacy Policy.
13. Liability
We aim to provide the website and digital products as described on the relevant product pages. Nothing in these Terms is intended to exclude or limit mandatory consumer rights or liability that cannot lawfully be excluded. Any final limitation of liability is subject to applicable law.
14. Privacy
Information about personal data and privacy is provided in the Privacy Policy.
15. Electronic Communications
We may contact you by electronic means for orders, payment or download information, account activity, customer support, and service or security notices. These Terms do not establish a newsletter or promotional email program.
16. Governing Law
These Terms are based on the laws of France. Mandatory consumer protections applicable to you are not intentionally excluded. Because Simulation Tone Shop sells worldwide, the application of this section should be reviewed in light of the customer’s location and applicable law.
17. Changes to These Terms
We may update these Terms when the website, products or applicable requirements change. The updated version will be published on this page. Any update remains subject to mandatory consumer protections.
